Domestic Violence Have You Been a Victim of Domestic Violence?

Barnholtz & Kugler will fight for your rights with compassionate, knowledgeable and, if needed, aggressive representation.

Domestic Violence Attorney in Valencia, CA

Have you been the victim of domestic violence?

If you have been the victim of domestic abuse or you have been accused of domestic abuse in a family law proceeding, the attorneys at Barnholtz & Kugler can assist you. A finding of domestic abuse and the issuance of a domestic violence restraining order can have significant consequences to the perpetrator, which can trigger a presumption against the perpetrator having custody if there are minor children between the parties (Family Code section 3044), a presumption against the perpetrator receiving spousal support (upon a criminal conviction for domestic violence within 5 years pursuant to Family Code section 4325), and can have a negative impact on current or future employment or employment opportunities. The issuance of a restraining order can provide for equally necessary protection for a victim of abuse. Whether you feel that you have been the victim of abuse, or that you have otherwise been wrongly accused of domestic abuse, you need experienced counsel to assert or otherwise protect your rights.

Domestic abuse in California is not limited to situations of physical abuse or physical injury. In fact, many forms of abuse do not involve direct physical contact between parties. The domestic violence prevention act (“DVPA”) defines “abuse” to include not only intentionally or recklessly causing or attempting to cause bodily injury, any sexual-related abuse, and the placement of another person in reasonable apprehension of imminent serious bodily injury, but it also more broadly identifies any behavior that has been, or could be, enjoined pursuant to Family Code section 6320. Such behavior includes threats, stalking, harassment, making annoying telephone calls, destroying personal property, contacting by mail or text (directly or indirectly) or generally disturbing the peace of the other party. Accordingly, unwanted and repeated phone calls or texts, showing up at someone’s house uninvited and for purposes of harassing the person, or engaging in other activity that is designed to destroy the mental or emotional calm of the other party can provide sufficient support for a domestic violence restraining order and a finding of abuse.
